      When a Court Sets the Chosen Law Aside

      Courts decline to apply a chosen law on four broad grounds. The chosen state may have no substantial relationship to the parties or the transaction and no other reasonable basis may exist for the choice. Applying the chosen law may contravene a fundamental policy of a state with a materially greater interest in the issue. A statute may expressly void the clause, as several states have done for employment covenants and consumer contracts.

      When a License Term Follows a Status Document

      Where a state issues a license on the strength of temporary lawful status, federal minimum standards require the card to expire no later than the underlying document. The result is a card valid for months rather than years, renewable only by presenting current status evidence and passing verification again. The difficulty is timing: extensions of the federal document are frequently pending when the state card expires, and states differ sharply in whether they will bridge that gap.

      The domiciliary administration of an estate takes place where the decedent was domiciled and governs personal property wherever located. Real property is governed by the law of the state where it sits, and transferring title generally requires a proceeding there. Ancillary administration is that second proceeding: shorter and confined to the local assets, but a separate case with its own filings and its own fiduciary appointment.

      When Two States Both Claim Authority

      Interstate custody law requires a court to check, before hearing a case, whether a proceeding concerning the same child is already pending elsewhere. Where one is, the court must stay its own proceeding and communicate with the other court, and it may not exercise jurisdiction if the other proceeding was commenced in a state with jurisdiction under the framework. Parties are required to disclose prior and pending proceedings in their first pleading, on pain of the court declining to act.

The first treats presence for education as presence for a temporary purpose, so time at university does not build a domicile on its own.       Wage and hour entitlements, paid leave contributions, unemployment insurance assignment, workers' compensation coverage and income tax withholding are each decided by rules that converge on the place where work is performed. The employer's location, the state of incorporation, the governing law clause and the employee's residence all matter far less, and in several contexts not at all. Because the rules are separate they can diverge at the edges, but the strong default is that the desk decides.

      A professional or commercial license is a state public benefit for federal purposes, so the federal restriction on benefits by status reaches it. That restriction contains an express route for states to provide the benefit anyway, by enacting an affirmative state law. The practical result is a three-way split: states that legislated a status condition, states that legislated the opposite and issue regardless, and states that legislated nothing and whose boards are operating on internal policy.

      A narrow class of positions carries an express citizenship condition: elected office, certain law enforcement and public safety roles in some states, notarial offices in a few, and positions that rest on a federal security clearance. Everything else is a matter of general licensing law, employer preference or federal contract terms, none of which is a citizenship requirement even where it functions like one.

      Immigration filings are handled in two broad ways. Many are adjudicated at centralized service centers on the papers, and those are indifferent to where the applicant lives. Others require an interview and are handled by the field office serving the applicant's address, and those transfer when the address changes. A transfer is an internal administrative step: the file moves, the case keeps its receipt date, and the receiving office schedules from its own calendar.
